LEGAL FACTS YOU NEED TO KNOW
Getting married in Australia does take time.
To begin the process, you must complete a Notice of Intended Marriage form (NOIM). The NOIM must be lodged with your celebrant at least ONE MONTH before your wedding date and not longer than 18 months before.
You and your partner must be at least 18 years of age and neither party can be already married to another person.
You cannot be in a prohibited relationship, which means that you cannot marry anyone in your direct line of ancestors or descendants and this includes adopted children.
Prior to the wedding day, both parties are required to sign a declaration stating that there is no legal impediment to your marriage. This declaration is on the reverse side of your official marriage certificate.
On your wedding day, you will need 2 witnesses who are over 18 years of age.
To complete the NOIM form, you will need:
- Documents to prove your date & place of birth – Australian Passport, Foreign Passport, Your original Birth Certificate or Extract of Birth.
- Photo ID – Driver’s Licence, Student ID or Proof of Age Card
- If you have been married before, you must provide evidence that the marriage has ended – Original Certificate of Divorce or Death Certificate of previous spouse. When a person has been divorced more than once, they need only produce proof of the most recent divorce.
- Any documents in a foreign language must be translated into English by a qualified NAATI approved translator and an official Translation Certificate must be supplied.
- If you have changed your name since birth, other than by marriage, you will need to supply a Change of Name certificate.
- All documents MUST be ORIGINAL as celebrants are not permitted to accept photocopies.
